The possible impact of recent and pending rulings
The more I think about the ruling ending the mask mandate, the more I begin to see the applications of it. Limiting the reach of non-legislative agencies and stripping them of powers illegally taken has long been overdue. This could open that door wide.
Take for example the “unruly passenger” dicate from the FAA, which is now permanent. Did this rule undergo the legal requirements? The mask mandate had not followed the Adminstrative Procedures Act, which requires notice and public comment as well as having to consider and respond to significant comments. See page 31 from the ruling.
And I also found it very interesting that when the administration appealed the mask ruling, they chose not to ask for a temporary injunction. Most thought that it was assured as it is a common practice. It begs the question if the DOJ knows it has a weak case at best, and would rather have it heard a ways down the road when the topic won’t attract much attention. But I digress.
This has the significant potential to allow the people to roll back the staggering overreaches of government. Should the USSC void Roe, that would be the beginning of restoring the 10th amendment as well, regardless of the root issue which I shall not address as the people should have the right to make thier own decisions, and that was the inital concept of the states.
Interesting times are ahead.
