Thoughts on the potential appeal to the mask ruling.
I sadly can believe the idiots at Faux News missed all my points. Basic shit, kiddos.
As a disclaimer, I am not a lawyer. But I play one on TV. I do most of my work for them, and am normally involved in analyzing cases as well as trial strategies and have been teaching certain law for decades so close enough to spout off.
The key takeaway here that I see from the phrasing in this article (which mirrors all others I’ve seen) is that the CDC insists masks are needed due to its “ongoing assessment”.

“to protect the CDC’s public health authority beyond the ongoing assessment”. Notice it’s NOT to slow Covid or protect the public health. They’re not even hiding the authoritarianism anymore.
Notice that they do not say that the measures are necessary based on current case (coughs in false positive rates), hospitalization, death rates, or spread rates. So how I read this is “well we don’t know anything but it might be bad”
“CDC will continue to monitor public health conditions to determine whether such an order remains necessary.” So they are flat out admitting they don’t even know if it is necessary. Again, not even hiding it.
“CDC believes this is a lawful order, well within CDC’s legal authority to protect public health," Ok so now they are legal experts as well as public health experts?
I read the decision and the judge Made a solid ruling based on existing law, nothing was politicized or incorrect.
If a judge grants an injunction on this weak ass argument they need to be tarred, feathered and run out of town on a rail.
